You can be charged with burglary without taking a single thing. Going into a place without permission with a plan to steal can be enough.
If you need a Benton burglary defense lawyer, our firm represents people charged in Benton. Our lead attorney, Eric G. Johnson, has practiced in Louisiana since 1993 and has tried felony cases in Bossier Parish.
The State must prove you went in and what you meant to do, so that is where we look first.
We work to get the charge dismissed or reduced, so one accusation does not unfairly impact your future. Share the accusation and your side of it with us. We will tell you which parts of the State’s case need the closest look and what your next steps could be.

318-377-1555Louisiana splits burglary into several charges, and each one carries different risks. The charge on your paperwork decides how much prison time a judge can order, so the label matters from the first day. Burglary includes:
Which charge you face changes the sentence, so we read the exact wording of your paperwork first.
The right defense depends on the facts of your case. The ones we often look at are:
Sometimes, more than one of these defenses may apply.
Simple burglary can mean up to 12 years in prison and a fine of up to $2,000 under La. R.S. 14:62. If you were armed with a firearm during a simple burglary, the minimum rises to three years. If the State says you broke into several places in one continuous run, the minimum is one year, and at least one year of your sentence comes without probation. Aggravated burglary is more serious. The sentence runs from one to 30 years at hard labor under La. R.S. 14:60. Hard labor is a legal term attached to prison sentences for felonies.
A conviction does more than fill years on a calendar. Many employers run background checks, and a burglary conviction can show up on them. Housing applications often ask about criminal history, too.
Felony burglary cases from Benton go to the 26th Judicial District Court. Its Bossier Parish home is the Bossier Parish Courthouse at 204 Burt Boulevard in Benton. A case filed in Benton belongs to the same judicial district as our Minden office in Webster parish. We go with you to each court date on Burt Boulevard. Before any court date, we go over what the judge will ask, what to wear, and what not to say, so you walk in prepared.
For simple burglary, the State generally has to prove two things: (1) you went into a home, vehicle, boat, or other structure without permission, and (2) you meant to steal or commit a felony when you did.
Permission is a recognized defense to burglary. The State may argue you never had it or lost it. Messages, key access, and witness statements often decide the question, and we collect that proof early.
Yes. We meet with you at our Minden office and handle your case at the Bossier Parish Courthouse in Benton. Both parishes share one district court.
In most cases, no. You have the right to stay silent, and you do not have to give a statement. Do not contact the person who accused you. Anything you say can be used to show you went in and what you planned, so talk with us first.
Sometimes. After we review the evidence, we negotiate with prosecutors to dismiss or reduce charges and sentences. Eric G. Johnson has done that work in Louisiana courts since 1993, and results depend on the unique facts of each case.
Theft is about taking property. Burglary is about going in without permission, with a plan to take property or to commit a felony. One event can lead to both charges, and each charge adds its own sentence risk.
Yes. A burglary investigation can change quickly, and early contact lets us speak with investigators for you. We can also start preserving video, messages, and witness names quickly.
