Existing laws prevent expungement of all records and only allow expungement in certain cases:

    • Charges dismissed
    • Acquitted
    • Completed diversion program

If you pleaded guilty to the charge and your charge is not exempt from expungement. In most cases, you must wait at least five years after you’ve completed your sentence before you can pursue expungement.

Felonies

    • Never prosecuted
    • Charges dismissed
    • Acquitted

If you pleaded guilty to the charge and you charge is not exempt from expungement in most cakes, you must wait at least ten years after you’ve completed your sentence before you can pursue expungement. That is only if you do not have any open felony charges and you have not been convicted of a felony in the ten years after your completed sentence.
